Pas de publicité via Bluetooth sans consentement préalable

Soucieuse de préserver la tranquillité des personnes, la CNIL exige le recueil du consentement préalablement à l’envoi de messages publicitaires par Bluetooth. La Commission affirme ainsi sa compétence sur des pratiques marketing qui se révèlent toujours plus intrusives.

De nombreux acteurs souhaitent développer des systèmes permettant d’envoyer des publicités sur les téléphones portables à partir de panneaux publicitaires intégrant des bornes Bluetooth.

Des déploiements ont été prévus dans des lieux très variés tels que le métro, la voie publique, des cafés, des discothèques et des salles de concerts.

En pratique, dès qu’une personne s’approche de ce type d’affiche, elle reçoit un message l’invitant à accepter la réception d’une publicité sur son téléphone, dès lors que la fonctionnalité Bluetooth de celui-ci est activée.

La CNIL a souhaité porter une attention toute particulière à ce nouveau mode de marketing direct particulièrement intrusif.

La Commission a conclu en séance plénière que :

la loi « informatique et libertés » est applicable. Elle considère en effet que les données techniques traitées dans le cadre du protocole de communication Bluetooth, à savoir l’adresse physique de l’interface du portable (adresse « MAC ») et l’identifiant « Bluetooth » du téléphone portable sont des données à caractère personnel ;
il est nécessaire de recueillir le consentement préalable du détenteur du téléphone dans la mesure où l’envoi de messages publicitaires sur des téléphones mobiles via la technologie « Bluetooth » constitue une prospection directe au moyen d’un courrier électronique ;
l’envoi d’un message demandant à l’utilisateur s’il accepte l’établissement d’une connexion Bluetooth n’est pas une modalité satisfaisante du recueil du consentement dans la mesure où elle intervient trop tardivement.

L’envoi systématique de messages publicitaires à tous les utilisateurs se trouvant dans la zone de couverture d’une affiche ne doit pas être la règle. D’ailleurs, la Commission a relevé qu’il existait des solutions permettant aux seules personnes réellement intéressées par le contenu publicitaire d’être sollicitées. C’est le cas, par exemple, lorsqu’elles doivent approcher de quelques centimètres leur téléphone de l’affiche afin de recevoir la publicité, ce qui atteste de leur volonté et de leur consentement.

Par cette décision, la CNIL réaffirme sa volonté de concilier le développement de technologies nouvelles et le respect des libertés individuelles et de la vie privée.
